1This agreement

These Terms & Conditions are an agreement between you and Brett Norman ("we", "us"), the operator of iRam Rail Maps.

They apply to the iRam Rail Maps mobile apps, the web app at app.irammaps.com.au, and this website. By creating an account or using the app, you accept these terms. If you don't accept them, don't use the app.

2Safety and reliance

You must not rely on iRam Maps in place of:

• the network owner's or operator's official records, diagrams and manuals;
• your employer's safe working procedures, safe work method statements, or risk assessments;
• a Protection Officer, worksite protection, or any form of track access authority;
• on-site verification of what is actually in front of you.

You remain responsible for complying with all applicable rail safety law, the network operator's rules, your employer's procedures, and the conditions of your RIW accreditation. Where the app disagrees with an official source or with what you can see on site, the official source and your own eyes win, every time.

The app shows asset locations. It does not tell you whether a section is under possession, whether the overhead is live, whether a signal is at stop, or whether it is safe to be where you are standing.

3Who can use it

To create an account you must:

• be at least 18 years old;
• hold a valid Rail Industry Worker (RIW) number;
• be located in Australia at the time of installation and registration;
• have a genuine work-related reason to access rail asset information.

We may verify these at any time. Accounts that do not meet them may be suspended or removed without notice.

4Your account

Give us accurate information when you register, and keep it current. One account per person.

You are responsible for everything that happens under your login. Keep your password to yourself — do not share it, and do not let anyone else use your account, including colleagues who do not hold a valid RIW number. Tell us promptly if you think your account has been compromised.

You can close your account at any time by emailing support@irammaps.com.au.

5Accuracy of information

Asset locations in iRam Maps are compiled from publicly available records of the Perth rail network, supplemented by reports from users in the field. We add and correct locations regularly.

Despite that, information in the app may be incomplete, out of date, or wrong. Assets move, get renumbered, get removed, and get added. Positions plotted on a map layer carry inherent error, and consumer GPS carries more.

The app is provided on an "as is" and "as available" basis. To the extent permitted by law, we make no warranty that the information is accurate, complete, current or fit for any particular purpose.

If you find something wrong, please report it — user reports are a large part of how the data stays useful.

6We are independent

iRam Rail Maps is an independent product built by a rail worker. We are not operated by, affiliated with, sponsored by, or endorsed by the Public Transport Authority of Western Australia, Transperth, Arc Infrastructure, or any other rail network owner, operator or authority.

Any trade marks, network names or line names referred to in the app belong to their respective owners and are used only to describe locations on the network.

7Acceptable use

You must not:

• share your account, or give access to anyone without a valid RIW number;
• scrape, bulk-download, export or systematically extract asset data from the app;
• republish, resell, or redistribute the asset data, in whole or in part;
• use the app or its data to plan, assist or carry out unlawful entry to the rail reserve, trespass, vandalism, theft, or interference with rail infrastructure;
• reverse engineer, decompile or tamper with the app, or attempt to access parts of the service you are not authorised to use;
• upload false asset reports, or anything unlawful, misleading or offensive;
• interfere with the operation of the service or the servers it runs on.

Breaching this section will cost you your access, and where the conduct is serious we may report it to the relevant rail operator or to the police.

8Intellectual property

The app, its design, its name, its logo, its database structure and its compiled dataset belong to us or our licensors. Your account gives you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own work purposes. It does not transfer ownership of anything.

If you send us a correction, a report or a suggestion, you grant us a perpetual, royalty-free licence to use it to improve the app. We won't identify you as its source unless you ask us to.

9Free of charge

iRam Maps is free to download and free to use. There are no ads, no in-app purchases and no subscription. We do not currently intend to charge for access.

That said, the app is provided at our discretion, and being free does not create an obligation on us to keep providing it. If that ever changes, we will give reasonable notice.

10Availability and changes

We do not guarantee that the app will be available, uninterrupted or error-free. It depends on your device, your network coverage, third party services, and infrastructure we don't control. Coverage in the rail reserve is often poor, and you should plan on the assumption the app may not be reachable when you need it.

We may change, suspend or withdraw features, or the whole service, at any time. We may also update these terms — the version number and dates at the top of this page show when they last changed, and material changes will be notified in the app or by email before they take effect.

11Suspension and termination

We may suspend or terminate your access, with or without notice, if you breach these terms, if your RIW number lapses or is found invalid, if we suspect misuse, or if we are required to by law.

Sections 2, 5, 6, 8, 12 and 15 survive termination.

12Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Where our liability can be limited, it is limited, at our option, to resupplying the service or paying the cost of having it resupplied. As the app is provided free of charge, that cost is nil.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, or business opportunity, arising from your use of or inability to use the app.

You agree that you use iRam Maps at your own risk, and that your safety on or near the rail reserve is governed by your training, your employer's procedures and the network operator's rules — not by this app.

13Third party services

The app displays Google Maps and hands off navigation to your device's own maps application. Those services are governed by their own terms and privacy policies, including the Google Maps/Google Earth Additional Terms of Service. We are not responsible for third party services and do not control their content or availability.

Downloads through the App Store or Google Play are also subject to those stores' own terms.

14Privacy

How we handle your personal information is set out in our Privacy Policy, which forms part of these terms.

15Governing law

These terms are governed by the laws of Western Australia. You and we submit to the non-exclusive jurisdiction of the courts of Western Australia and the courts able to hear appeals from them.

If any part of these terms is found unenforceable, that part is severed and the rest continues to apply.
